Scope of Services & Studio Model
KITO.works operates as an elite, lean digital studio specializing in custom high-performance web engineering, local SEO structural optimization, and hands-free maintenance setups. We consciously avoid heavy, slow agency systems to guarantee direct senior-level developer attention on all contracted builds.
Packaging Structure & Commitments
By purchasing a specific design and development pipeline tier, you explicitly accept the binding conditions of that specific layout model:
The Flex Plan (Subscription Build): To reduce high upfront engineering barriers for small and local businesses, the Flex tier splits development expenses across an ongoing 24-month structured commitment. Selecting this option requires a continuous monthly payment profile. Early cancellation or service termination prior to the completion of the 24-month term triggers immediate maturation of the remaining balance, which becomes due instantly.
The Premium Plan (Flat-Rate Ownership): This structural option requires a one-time upfront fixed asset fee. Upon launch validation and complete financial clearance, all design files, custom blocks, and built code structures map directly to your enterprise ownership files.
The Enterprise Tier (Custom Architectures): Governed dynamically by isolated master service agreements tailored explicitly to long-form requirements, custom backends, and high-traffic multi-page specifications.
Client Onboarding & Intake Requirements
To deliver optimized web assets in highly condensed timelines, our design systems require intense strategic focus. You acknowledge that project timelines depend explicitly on your direct, detailed input. Mandatory text areas in our signup modules must be populated with accurate business frameworks, visual references, and functional objectives. KITO.works reserves the right to postpone project kickoff dates if client content, image assets, or technical credentials fail to meet our baseline development parameters.
Intellectual Property & Code Ownership Rights
Ownership distribution varies transparently according to your active service package tier:
Design Assets & Text Material: You retain complete ownership rights over all raw content text, branded logos, industry images, and business profiles you feed into our intake modules.
System Code Frameworks: KITO.works holds proprietary rights over optimized underlying foundational frameworks, customized logic scripts, and performance-tuning configurations. Once your account balance is paid in full (or upon completing the 24-month Flex term), you receive a permanent, non-revocable, royalty-free operating license to run, scale, and host your completed front-end layout freely.
Portfolio Attribution: KITO.works reserves the direct right to showcase your completed platform screens, speed ratings, and search placement transformations within our own case studies, blog blueprints, and performance promotional reels.
Technical Hosting & Maintenance Guarantees
For packages featuring integrated "Hands-Free Upkeep," we oversee system monitoring, core file updates, and technical adjustments. While we build on ultra-premium web infrastructure (such as Framer or specialized content delivery arrays) to maintain instant load times, we do not operate the underlying global hardware servers directly. KITO.works cannot be held financially or legally responsible for sudden third-party network outages, domain registrar disconnects, or upstream service disruptions beyond our immediate studio control.
Limitation of Liability
To the absolute maximum extent permitted under applicable regional statutes, KITO.works, its chief creative officer, and its network partners shall not be held liable for indirect, incidental, accidental, special, consequential, or punitive damages. This includes, without limitation, direct loss of local business profits, localized data failures, operational downtime, or negative search ranking adjustments stemming from your use or inability to use our delivered digital properties.
Governing Law & Local Dispute Resolution
These terms, structural rules, and active operational agreements are governed completely by the laws of the Commonwealth of Virginia, United States, ignoring standard conflict of law parameters. Any formal legal action or judicial dispute directly or indirectly linked to our studio contracts must be processed exclusively within state or federal courts operating inside the borders of Virginia.
Structural Changes to Terms
We hold the explicit right to modify, adjust, or replace these Terms of Service at any time to account for changing cloud technologies, compliance shifts, or system framework upgrades. Your ongoing presence on our platform and use of our managed hosting tiers following notice of adjustments constitutes complete acceptance of the updated rules.
